By using GestaPlena, you fully agree to the terms and conditions described in this document. Read them carefully before using the app.
1. Acceptance of Terms
Downloading, installing, or using the GestaPlena application constitutes full acceptance of these Terms of Use and the Privacy Policy. If you do not agree with any provision, we recommend that you do not use the app.
2. Service Description
GestaPlena is a mobile pregnancy tracking and informational app, with the following features:
- Calculation of pregnancy week and estimated due date from the Last Menstrual Period (LMP)
- Weekly content on baby development (size, milestones, expected symptoms)
- Trimester checklist for care and exams
- Personal pregnancy diary with text, symptoms, and photos
- 40-week timeline with highlights
- Optional baby name meaning lookup (AI-powered)
- Local reminders for milestones and appointments
- Offline-first architecture: personal data always on-device
3. Legal Notice and Health Limitations
GestaPlena does not replace prenatal consultations with your obstetrician or gynecologist.
- The app is an informational and personal tracking tool, not a medical service
- Weekly content is based on general pregnancy literature and may not reflect your specific situation
- Always consult an OB/GYN before making decisions about exams, medications, diet, or physical activity
- In case of any warning signs (bleeding, severe pain, absence of fetal movement, high blood pressure, etc.), seek medical care immediately
- Pregnancy week calculation from LMP is an estimate; only professional ultrasounds provide accurate dating
- App reminders depend on correct operation of your device's notification system and should not be considered infallible
4. Free Application
GestaPlena is a free application, provided without charges, ads, or in-app purchases. There are no paid plans or hidden premium features.
5. Conditions of Use
By using GestaPlena, the user agrees to:
- Use the app only for personal, legitimate purposes related to tracking their own pregnancy
- Not reverse engineer, decompile, or modify the software
- Not use the app for illegal purposes or in violation of applicable law
- Not redistribute, resell, or commercially exploit the app or its content
- Remain solely responsible for the accuracy of the data entered
- Respect the Terms of Service of the respective stores (App Store / Google Play)
6. Intellectual Property
GestaPlena, including source code, design, trademarks, logos, interface, text, illustrations, and other content, is the exclusive property of DevSkin. Reproduction, modification, distribution, or commercial use without prior written authorization is prohibited.
User-generated content (LMP, diary, photos, notes) remains the property of the user, stored locally on their device.
7. Limitation of Liability
GestaPlena is provided "as is", without express or implied warranties regarding:
- Absolute accuracy of pregnancy week calculation and estimated due date
- Completeness or timeliness of informational content
- Uninterrupted or error-free operation
- Compatibility with future iOS or Android versions
- Fitness for any specific purpose, including medical decisions
- Prevention of accidental loss of local data
DevSkin is not liable for direct, indirect, incidental, or consequential damages arising from use of the app, including but not limited to:
- Health decisions based exclusively on the app
- Loss of local data due to device failure, uninstallation, or system corruption
- Delay or absence of notifications due to system settings
- AI-generated interpretations for name meanings
Keeping regular device backups (iCloud, Google Drive, etc.) is recommended.
8. Privacy
Use of GestaPlena is subject to our Privacy Policy. In summary: personal pregnancy data never leaves the device. Only name meaning queries are processed on an external server.
9. Changes to the Terms
These terms may be modified at any time at DevSkin's discretion. Significant changes will be communicated through app updates. Continued use after changes implies acceptance of the new terms.
10. Termination
The user may terminate use of the app at any time by simply uninstalling it from their device. DevSkin reserves the right to discontinue the app, suspend updates, or modify features at any time.
11. Governing Law
These terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo/SP are designated as competent to resolve any disputes arising from this instrument, with express waiver of any other, however privileged.
12. General Provisions
If any provision of these Terms of Use is deemed invalid or unenforceable, the remaining provisions shall remain in full force. Tolerance of a breach of any clause shall not constitute waiver of rights.
